Terms of Service

1. Acceptance of Terms

By creating an account or using Reception Now (the “Service”), you agree to these Terms of Service (“Terms”). If you are using the Service on behalf of a business, you represent that you have authority to bind that business. If you do not agree, do not use the Service.

2. Description of the Service

Reception Now provides AI-powered virtual receptionist services, including automated phone answering, appointment scheduling assistance, lead capture, and optional AI-assisted hiring tools. The Service is designed for small and medium-sized businesses (“Customers”).

The AI agent that answers calls on your behalf will identify itself as an AI assistant and will not impersonate a human employee. You may not configure the agent to misrepresent itself as a human caller.

3. Account Registration & Security

You must provide accurate registration information and keep it current. You are responsible for all activity that occurs under your account. You must notify us immediately at support@receptionnow.com if you suspect unauthorized access. We reserve the right to suspend accounts that show signs of unauthorized use or abuse.

4. Subscription Plans & Billing

Reception Now offers subscription plans billed monthly. Current pricing is listed on our website. Prices may change with 30 days' notice.

Subscriptions auto-renew each month. You may cancel at any time through your dashboard. Cancellation takes effect at the end of your current billing period; no partial-month refunds are issued. If your payment fails, we may suspend your Service until payment is received.

Payments are processed by Stripe. We do not store your full payment card details on our servers.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right.
• Make calls or send messages without appropriate consent from recipients.
• Harass, threaten, or defraud any person.
• Violate the Telephone Consumer Protection Act (TCPA) or any similar law.
• Provide medical advice, legal counsel, or financial advisory services.
• Operate in industries we explicitly exclude (see Section 6).
• Reverse engineer, scrape, or interfere with the Service infrastructure.

6. Excluded Industries

The Service is not available to healthcare providers subject to HIPAA, financial advisors regulated by FINRA or the SEC, law firms providing privileged legal advice, or any business whose primary activity is regulated financial services. We reserve the right to terminate accounts operating in excluded categories.

7. AI & Voice Disclosures

The automated voice agent deployed through our Service is powered by third-party AI technology and voice synthesis. Call quality, accuracy, and availability depend on third-party providers and network conditions. We do not guarantee that the agent will correctly handle every call.

You are responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction regarding automated calling, call recording consent, and AI disclosure. Some states require that callers be notified when they are speaking with an AI or when a call is being recorded.

The “book appointment” feature captures lead information and creates a follow-up task; it does not integrate with external calendar systems unless explicitly configured.

8. Data & Call Recordings

Calls handled by the Service may be recorded and transcribed. You are responsible for obtaining any required consent from callers before enabling recording. By enabling recording, you represent that you have the legal right to record calls in your jurisdiction and with your callers.

We store call logs, transcripts, and lead data on your behalf for the retention period you configure (default: 30 days). You can adjust this or delete your data at any time from your dashboard.

9. Intellectual Property

Reception Now and its licensors retain all rights to the Service, including software, trademarks, and AI models. You retain all rights to your business data, call recordings, and content you provide. You grant us a limited license to process your data for the purpose of providing the Service.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE AI AGENT WILL HANDLE EVERY CALL CORRECTLY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECEPTION NOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, BUSINESS OPPORTUNITIES, OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE FEES PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Reception Now and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or any applicable law.

13. Termination

Either party may terminate the agreement at any time. You may close your account from the dashboard. We may suspend or terminate your account immediately if you violate these Terms, engage in fraud, or cause harm to others or to the Service. Upon termination, your data will be deleted within 90 days unless earlier deletion is requested.

14. Changes to Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes by email or in-app notification. Continued use of the Service after the effective date of updated Terms constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved by binding arbitration under the American Arbitration Association's Commercial Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to a jury trial or class-action lawsuit.
